  • Job or function titles (e.g. graduate engineer, sales manager).

You have the possibility to file a complaint with a data protection supervisory authority at any time.Data of our customer for the fulfillment of the contractual relationship with our customer and the related implementation of pre-contractual measures on the basis of Art. 6 para. 1 lit. b) DSGVO.

  • Data of our customer and other data subjects for the fulfillment of legal obligations (e.g. from the Metering Point Operation Act and because of commercial or tax law requirements) on the basis of Art. 6 Para. 1 lit. c) DSGVO.
  • Data of our customer and other data subjects for the performance of tasks that are in the public interest (e.g. from the MsbG) on the basis of Art. 6 Para. 1 lit. e) DSGVO.
  • Data of other data subjects for the fulfillment of the contractual relationship with our customer and the related implementation of pre-contractual measures on the basis of Art. 6 para. 1 lit. f) DSGVO, since the fulfillment of the contractual relationship with our customer and the related implementation of pre-contractual measures represent both our legitimate interest and that of our customer.
  • Data of our customer and other data subjects for direct advertising concerning our customer based on Art. 6 para. 1 lit. f) DSGVO, as direct advertising represents our legitimate interest.
  • Data of our private customer (no tradesmen) if necessary also for telephone advertising and/or e-mail advertising on the basis of explicit consent pursuant to Art. 6 (1) a) DSGVO. You may revoke your consent to telephone advertising and/or e-mail advertising at any time.   • Data of our customer to assess the creditworthiness of our customer based on Art. 6 para. 1 lit. b) DSGVO as a pre-contractual measure and Art. 6 para. 1 lit. f) DSGVO, as the determination of the creditworthiness of our customer to minimize default risks is our legitimate interest.
    • In this context, personal data identifying our customer (name, address and date of birth) as well as data on non-contractual or fraudulent behavior will be transmitted to the credit reference agency Creditreform Dr. Schlegel Kassel KG, Hedwigstr. 16, 34117 Kassel, Germany, in order to determine creditworthiness.
    • The credit agency processes the data received and also uses it for profiling purposes (scoring) to provide third parties with information for assessing the creditworthiness of our customer. Among other things, address data of our customer is included in the calculation of creditworthiness.

Is there any disclosure of my personal data to other recipients?

Your personal data will be disclosed or transferred - insofar as necessary for the purposes stated under 2. above - exclusively to the following recipients or categories of recipients:

  • Metering point operators,
  • balancing group managers,
  • network operators,
  • suppliers,
  • transmission system operators,
  • subsidiaries and affiliates,
  • credit agencies,
  • billing or IT service providers,
  • other authorized parties (e.g. authorities and courts), insofar as there is a legal obligation or authorization to do so

Will my personal data be transferred to or in third countries?

Your personal data will not be transferred to or in third countries or to international organizations.

For how long will my personal data be stored?

Personal data will be stored for the purposes stated under 2. as long as this is necessary for the fulfillment of these purposes. If there are statutory retention obligations, in particular from commercial and tax law (§§ 147 AO, 257 HGB), we are obliged to store the data until the expiry of these periods. For the purpose of direct advertising, your personal data will be stored for as long as there is an overriding legal interest of our company in the processing in accordance with the relevant legal provisions, but for no longer than two years beyond the end of the contract, or until you object to the processing for the purpose of direct advertising or revoke any consent given for this purpose.

What rights do I have with regard to the processing of my personal data?

  • Right to information about your stored personal data (Art. 15 DSGVO),
  • Right to rectification if the stored data concerning you is incorrect, outdated or otherwise inaccurate (Art. 16 DSGVO),
  • Right to erasure if the storage is inadmissible, the purpose of the processing is fulfilled and the storage is therefore no longer necessary or you have revoked a given consent to process certain personal data (Art. 17 DSGVO),
  • Right to restriction of processing if one of the conditions specified in Art. 18(1) DSGVO is met (Art. 18 DSGVO),
  • Right to transfer the personal data you have provided that concerns you (Art. 20 DSGVO),
  • Right to withdraw consent given, whereby the withdrawal does not affect the lawfulness of the processing carried out up to that point on the basis of the consent (Art. 7(3) DSGVO), and
  • Right to lodge a complaint with a supervisory authority (Art. 77 GDPR).

Is the provision of personal data required by law or contract, or is it necessary for the conclusion of a contract? Is there an obligation to provide the personal data and what are the possible consequences of not providing it?

Within the scope of the energy supply relationship, our customer shall provide us with such personal data (cf. Section 2) as are required for the conclusion and performance of the energy supply relationship and the fulfillment of the associated contractual obligations. By its nature, this also includes contact data of employees or third parties (e.g. vicarious agents or service providers) which our customer makes use of by mutual agreement. Without the required data as well as mutual personal communication with the responsible employees - or, if our customer so desires, further third parties - the energy supply relationship may not be concluded or fulfilled.

Does automated decision making including profiling take place?

No automated decision-making, including profiling, shall take place for the conclusion and fulfillment of the energy supply relationship.

What are the sources of the personal data processed?

We process personal data that we receive from our customer or from you within the scope of the energy supply relationship with our customer. We also process personal data that we have been permitted to obtain from publicly accessible sources, e.g. from land registers, commercial registers and the Internet. In addition, we process personal data that we are permitted to obtain from companies within our group or from third parties, e.g. network operators.

Right of objection

You may object to us processing your personal data for direct marketing purposes at any time without giving reasons. We will no longer process the personal data for direct marketing purposes after receipt of the objection and will delete the data if processing is not necessary for other purposes (for example, to fulfill the contractual relationship with our customer).

You may also object to other processing that we base on the performance of a task that is in the public interest within the meaning of Art. 6 (1) (e) DSGVO or on a legitimate interest within the meaning of Art. 6 (1) (f) DSGVO: (for example, transfers of personal data on non-contractual or fraudulent behavior of our customer to credit agencies) at any time for reasons arising from your particular situation, stating these reasons. In the event of a justified objection, we will generally no longer process the personal data for the purposes in question and delete the data, unless we can demonstrate compelling reasons for the processing that override your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.
